The “Program” means the personal development program by Amy Martin (owner of Amy Barfield Martin/ amybarfieldmartin.com). I expressly acknowledge that Amy Martin is a coach who believes in the benefits of therapy. I further expressly acknowledge and agree that Amy is not a licensed mental health counselor and that she is not, and will not be, responsible for assessing, diagnosing, or treating any aspect of my health (including behavioral, mental, emotional, and physical) and that she has no duty to recommend that I seek services. If Amy recommends services, it will be up to me whether to seek them.
My participation in or other use of the Program does not and will not establish a counselor-patient relationship, or similar relationship, with Amy Martin.
PRICES AND PAYMENT
The fee for the Online “Program” is calculated and payable in advance of the course start date as set out on amybarfieldmartin.com. Amy Barfield Martin shall be under no obligation to provide the “Program” until the fee has been paid.
You agree that you are financially willing and able to invest in this Program, Product or Service by choice, and that by so doing, you are not incurring any economic hardship in any way.
In the event that payment is not received by the date due, you will have a three (3) day grace period to make the payment otherwise the Program, Product or Services will not continue and we reserve the right to cease your access immediately and permanently.
If you fail to make payment in a timely manner in accordance with these Terms of Use or voluntarily decide to withdraw from our Programs, Products or Services at any time or for any reason whatsoever, you still will remain fully responsible for the full cost of the Programs, Products and/or Services.
REFUND POLICY
Due to the extensive time, effort, preparation and care that goes into creating and/or providing the Programs, Products, Services and Program Materials offered through amybarfieldmartin.com, refunds are not offered for this container.
By using and/or purchasing any of the Programs, Products, Services or Program Materials offered through Amy Martin and/or amybarfieldmartin.com, you understand and agree that all sales are final and no refunds will be provided.
THE PROGRAM
As part of the Program, Amy Martin, shall provide the following to Client.
Access To Program Area – Amy Barfield Martin shall maintain a Program Area that may include lessons, forms, worksheets, checklists, and other information. You shall have access to this Program Area for a period of 12 months.
MEDICAL DISCLAIMER
I agree that Amy Martin unequivocally and comprehensively disclaims offering any medical or mental/behavioral health advice; that the Program does not constitute or contain medical advice or mental/behavioral health advice, nor does it serve as a substitute for such advice; and that only a licensed professional should assess, diagnose, and treat medical, mental, and behavioral health conditions.
ACCESS AND NON ACCESS
I agree that I indemnify and will hold Amy Martin harmless from all claims arising out of or related to my access or use of, or my inability to access or use, the Program, Amy’s site or the sites to which it provides links.
NO HARM TO OTHERS
I represent, warrant, and agree that no content that I provide in connection with my participation or other use of the Program will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, and that it will not breach or conflict with any obligation of mine, such as a confidentiality obligation, or contain defamatory or otherwise unlawful material. I further agree that I will not disparage or cause harm to any other Program user or participant or to their property (both tangible and intangible), and that I indemnify and will hold Amy Martin harmless from any claims by third parties that arise in connection with my alleged breach of this provision.
COPYRIGHT AND TRADEMARK
The copyright in the Program and the contents of Amy Barfield Martin’s site belong to Amy Martin. I agree that I will not infringe the copyright or trademark rights of Amy Martin and if I breach this provision I will be liable to Amy Martin for statutory and other damages and reasonable attorney’s fees.
NO LICENSE
My participation in the Program is exclusively personal. I acknowledge and agree that Amy Martin is not granting me a license to (and does not permit me to) copy or otherwise use her Program or any aspect thereof as a coach, teacher, or instructor, whether commercially or as a volunteer.
RELEASE AND WAIVER
I agree that Amy Martin shall not be liable to me or anyone else for any decision I make or action I take in reliance on information Amy provides via the Program or otherwise, or for any consequential, special or similar damages, even if advised of the possibility of such damages. I, on behalf of myself and anyone claiming through me (including successors, heirs, personal representatives, and assigns) hereby knowingly, voluntarily, and irrevocably waive, and unconditionally release, acquit, and forever discharge Amy Martin, her successors and assigns, as well as her past and present employees, venturers, partners, attorneys, and anyone claiming through them (collectively referred to as the Releases), in their individual and corporate capacities, from any and all claims, liabilities, promises, actions, damages, and the like, known or unknown, which I ever had, now have, or may arise in the future against any of the Releases arising out of or relating to my use of the Program, Amy Barfield Martin’s site, and sites to which it provides links.
Said claims include, but are not limited to, claims based on breach of contract, and on any tort, including but not limited to invasion of privacy, defamation, fraud, negligence, and the infliction of emotional distress, both intentional and negligent.
